Commercial Strategy, LLC is a management and intellectual property consulting firm with deeply experienced principals and staff who have advised business leaders in Fortune 500 companies in more than 40 successful intellectual property engagements which have produced significant monetary and strategic value for our clients.

Value to Client: We evaluate each project to determine whether or not we can deliver a meaningful result and return on investment and we provide each client with all information necessary to determine whether or not to invest in a project. Our engagements are structured to allow our clients to manage the cost of each project against the reality of actual commercial value of their portfolio. Our “best in class” tools, frameworks, and processes are transferred to the client and enable them to:

Our Approach: We focus on empowering our clients to use intellectual property as a business asset to support business strategy, solve business problems and create independent economic value. Relevant data acquisition and analysis is at the heart of our process. In all cases, we strive to determine which data and what analysis will be required to inform the decisions our clients must make. We first frame the business objectives and develop the scope of work, then gather, organize and analyze the critical data to build an independent business case for or against the objectives.

We work in a solid collaborative partnership in which decisions are made with our clients in possession of all available information. In this way, we are united in objective, approach and work plan and our knowledge is transferred to the client as a function of the engagement.

Service Offerings: Our intellectual property engagements typically include any combination of competitive intelligence, strategy development, commercialization, monetization, and asset management. Each engagement will typically involve the use of industry “best practices” in analysis and decision support to develop the learnings and insights to create measurable commercial value.

We do not work in the abstract, but focus instead on understanding the actual facts, circumstances and conditions our clients face. We have successfully used our “data first” approach (in cooperation with our clients’ team and their IP Counsel) in a wide variety of engagements to guide and inform:

• IP investment, commercialization and monetization
• Research and development projects, expenditures and new product introductions
• Patent prosecution, portfolio development and product clearance

Constant Learning and Improvement: Our team keeps abreast of industry “best practices” and constantly improves its knowledge, skills and offerings through industry benchmarking of the strongest Fortune 500 companies. Commercial Strategy will, for example, launch in July, 2007 an “industry first” benchmarking study focused on “Successful IP Monetization” to identify, document, test and evaluate the “best practices” in Intellectual Asset Management, IP Commercialization and Monetization and Transaction Structures.

The new Benchmarking Study will focus on successful IP investment strategy, business models, organizational structures, management reporting tools, financial measures, internal and external business development, market intelligence, transaction models, criteria development, decision – making tools, pipeline management, opportunity analyses and valuation processes.

Participants include GE, P&G, 3M, Ford, Kodak, Dow Tyco and DuPont. Participation will be limited to 40 companies in selected industry sectors.
